Gascon’s Boner: Kokkari-Boozing Drunk Driver Kills a Tourist Then Runs – But Only a Year in Jail for Joshua Calder?

Wow, this case ended up with a plea bargain for just twelve months in jail?

But late last month it evaporated into nothingness, into a simple jail term.

So, you can booze it up at world-famous Kokkari restaurant, run over a German tourist despite your gf yelling at you to look out, get out of the car to move the German tourist’s bike off of the road (no, not him himself, just the bike, you leave the dude himself to die), get back into the car after switching seats with the gf, and then drive away, and your punishment, years later, will be, what six months, eight months, in county jail because that’s what District Attorney George Gascon is willing to sign off on. No trial, no nothing, just a plea deal.

So what would Joshua Calder have gotten without the hitting and the running and the seat switching? Three months? Community service?

Mmmm….

    I’m going to have to assume that Calder’s record was otherwise clean and that he hadn’t gotten caught for DUI before.

    If I were a next of kin living in the EU, I’d probably be thinking that any wrongful death payments would be larger the more Calder can earn.

    Strava is a defense for Bucchere, possibly. To explain his behaviour. “I got carried away” kind of deal.

    And don’t overlook the message he sent out after he hit Hui. That kind of thing makes it tough for a DA to go for a plea. Calder kept his mouth shut for the most part. Buccere did not. Huge difference.

    Moral of the story:
    1. If you want to murder somebody, run them over with an SUV; and
    2. Hope that Gascon is the DA.

    Calder let his girlfriend’s driving do the talking after he hit Linke…

    I could see this happening…. The same judge will put Bucchere in the clink for 2 years simply because he does not have the power to punish him by suspending his driver’s license for 5 years like he did to Calder. There is no reason to “punish” him by putting him in AA. I’d rather have no license for 5 years than a year in jail. Offenses on a bike should go against your DL.

    I suppose instead of DL revocation or AA there is always Community service.

    I’ve heard some people talking about how she was forced to do what she did, you know, like peer pressure forces people to do things…

    Your lawyer friend discussed the possibility of a phantom cyclist fleeing the Castro scene. Your lawyer friend questioned whether Bucchere would even get charged. Your lawyer friend seems to really value Strava’s sponsorship of his riding team. Oh well.
