“U.S. Supreme Court sets Prop 8 oral argument date for March 26
DOMA challenge scheduled for the next day, setting the stage for back-to-back showdown over LGBT civil rights
SAN FRANCISCO (Jan. 7, 2013) — The U.S. Supreme Court moments ago published its formal argument calendar for March 2013, scheduling oral arguments in the federal constitutional challenge to California’s Proposition 8, called Hollingsworth v. Perry, for March 26, beginning at 10:00 a.m. EDT (7:00 a.m. PDT).
Another case that is also related to same-sex marriage rights — a challenge to the constitutionality of the federal Defense of Marriage Act, or DOMA — will be heard the following day, on March 27, at the same time. That case is called United States v. Windsor.
In granting review to both marquee marriage equality cases exactly one month ago, the nation’s highest court set the stage for potentially landmark rulings on LGBT civil rights that promise to be the most eagerly-anticipated of the current court term. Rulings are expected by the end of June.
The legal issues at stake in the challenge to Prop 8, the controversial 2008 ballot measure that eliminated marriage rights for same-sex partners in California, are two-fold: first, whether the Equal Protection Clause of the Fourteenth Amendment prohibits the State of California from defining marriage as the union of a man and a woman; and second, whether the proponents of Prop 8 have legal standing to litigate the case.
The American Foundation for Equal Rights filed the lawsuit in May 2009 on behalf two California couples who sought to marry: Kris Perry and Sandy Stier, and Paul Katami and Jeff Zarrillo. They are represented by lead counsel Theodore B. Olson and David Boies. City Attorney Dennis Herrera intervened as a co-plaintiff in the case in August 2009, renewing San Francisco’s groundbreaking pubic sector legal advocacy for the broader societal interest to end marriage discrimination against lesbian and gay couples. At trial, Herrera and his legal team provided extensive evidence that state and local governments derive significant societal and economic benefits when same-sex partners enjoy equal marriage rights — and, conversely, that denying such rights inflicts grave injustices on the LGBT community that, in turn, harm government and society at large.
When the high court granted review to the case on Dec. 7, 2012, Herrera said: “The federal challenge to Prop 8 represents one of the most significant civil rights cases to be taken up by the U.S. Supreme Court in decades, and I’m confident that the high court will reach a decision that reaffirms our Constitution’s promise of equal protection under the law.”
The U.S. Supreme Court’s argument calendar for March is published online here:
http://www.supremecourt.gov/oral_arguments/argument_calendars/MonthlyArgumentCalMar2013.pdf
The comprehensive timeline of San Francisco’s legal battle for marriage equality since February 2004 is available on City Attorney Dennis Herrera’s website at:
http://www.sfcityattorney.org/index.aspx?page=23
The Prop 8 case is: Hollingsworth v. Perry, U.S. Supreme Court, Docket No. 12-144. The DOMA case is: United States v. Windsor, U.S. Supreme Court, Docket No. 12-307.”
Tink happy tots…

So here’s the question – what would you do if you were at the Bay to Breakers party and a cop tries to take away your beer or make you pour it out? Would you:
1. Grudgingly comply; or
2. Assume a fighting posture not unlike that of that leprechaun from Notre Dame and then start yelling, “Tase me, bro!”
If you answered 1, then you’ve got no worries, Bro-ham.
Click here to learn about the legalities of BtoB and click here to learn about the practicalities (“Why You Should Crash the Bay to Breakers Even Though It’s Sold-Out“) of BtoB.
See you there!

Uh oh, this is new for 2011 at the annual Bay to Breakers street party:
“Installation of fencing along the portion of the race beside the Panhandle will begin at 12:01am on race day”
What will the fence be made of? Mmmmm….
Will it be an impenetrable paywall such that spectators (and non-spectators) won’t be able to get from the north side of Fell Street to the south side of Fell Street for hours and hours?
Did the residents sign off on this? Don’t think so. Appears as if the Great Fence of the 94117 is the brainchild of the co-sponsoring Western Addition / Inner Sunset NIMBY groups what are partially in charge of the show this year, you know, along with the “owner” of BtoB, that guy that supported anti-gay Proposition 8 even though he doesn’t live in California. Isn’t that funny?
Actually, most of the people who live near the Panhandle aren’t the rich, uptight, old, white, homeowners that the MSM loves to quote all the time.
Typical non-NIMBYs of the Panhandle area having a good time and drinking on a dreaded sunny day. See how non-uptight and non-judgmental they are?

Anyway, let’s hope the new fencing doesn’t kill anybody…

Chief Administrative Officer Bill Lee has just announced that gay marriages will once again occur at City Hall, assuming all goes well. That date and time is Wednesday, August 18th, 2010 at 5:00 PM.
So, that will give any judges who want to do anything about it plenty of time to ponder such matters. If no higher judge takes steps to put the kibosh on, it’ll be just like 2004 all over again, starting Wednesday.
Mark your calendars…

Our California Attorney General Jerry Brown can’t abide those who wish to take away the right of same-sex couples to marry in California.
So, in reaction to today’s news about Proposition 8 being ruled unconstitutional…

Vanessa & Maria Heading to City Hall to Get Married by Steve Rhodes
…JB has chirped up. Thusly:
Brown Issues Statement on Today’s Ruling on Proposition 8
Attorney General Edmund G. Brown Jr.’s statement on Judge Walker’s ruling on Proposition 8 today:
“In striking down Proposition 8, Judge Walker came to the same conclusion I did when I declined to defend it: Proposition 8 violates the equal protection guarantee of the Fourteenth Amendment of the United States Constitution by taking away the right of same-sex couples to marry, without a sufficient governmental interest.”

And actually, they’re already here. Anyway, up to 80,000 members of The Church of Jesus Christ of Latter-day Saints are fixing on volunteering to clean up 200 state, regional and city parks all over the Golden State on May 8th, 2010.

After that whole Proposition 8 thing, the Mormons* can use all the good ink they can get, right?
Now, how will San Francisco react?
All friendly?

Or all sore, like a year or so ago?

80,000 Volunteering to Help Renew California’s Parks on Saturday. Mormon Helping Hands to Perform Necessary Labor at 200 Parks Throughout State
CALIFORNIA, May 4 — Up to 80,000 members of The Church of Jesus Christ of Latter-day Saints and their friends throughout California will volunteer on Saturday, May 8, by laboring in state, regional and city parks that have been hit hard by the recent downturn in the economy.
Under the banner of Mormon Helping Hands, an international volunteer program of the Church that has provided manpower in distressed communities and organized relief efforts after natural disasters, the LDS volunteers have chosen parks in their own communities to perform work that ranges from clean-up and maintenance to painting and construction projects.
“Members of the Church in the 1840s were instrumental in the establishment and building up of the major cities of the state, from San Diego and Los Angeles to San Francisco and Sacramento,” said L. Whitney Clayton who presides over California for the Church. “We want to follow Jesus Christ’s example of service to others by helping to improve the communities in which we live, especially during these tough economic times for local and state governments.”
Church members and their neighbors and friends will perform service in about 200 parks throughout the state. Here are just a few of the projects:
– In Sacramento County: Construction of a natural playground, weeding of
non-native plants, restoration of a pond and other projects at Effie
Yeaw Nature Center in Carmichael. Funding for Effie Yeaw is being cut
from the county budget July 1 and the work projects are part of an
effort to keep the nature center open.
– In Coloma: The painting and restoration of several buildings at the
Marshall Gold Discovery State Historic Park, where early members of
the Church helped to discover gold and spark the Gold Rush. The state
park has been threatened with closure.
– In San Diego: More than 1,000 volunteers will be performing beach
clean-up projects up and down the southern coast.
– In Redlands: Church congregations have coordinated with the city to
refurbish public facilities and add amenities at local parks. The
project received a $35,000 grant from the Home Depot Foundation to
cover the cost of materials.
– In Red Bluff: Hundreds of volunteers will perform projects at the
William B. Ide Adobe State Historic Park. Ide, an early Mormon, was a
pre-Gold Rush pioneer who was the first and only President of the
California Republic under the Bear Flag Party Proclamation of 1846.
– In Los Angeles: Church congregations will work with the City of Los
Angeles to clean and restore sections of the iconic Griffith Park. LA
City Councilman Tom LaBonge has been instrumental in supporting the
volunteer efforts as a model for volunteer and municipal resources
working in harmony to accomplish a worthwhile project for the
community.
– In Inglewood: the Jesse Owens Community Regional Park will undergo a
transformation for the first time in 20 years as church congregations
paint walls, buildings and fences, plant new shrubbery and perform
general cleanup.
– In San Dimas: Church congregations will work to paint, clear foliage
and clean up on the grounds of the McKinley Home for Children, an
organization that helps repair the lives of abused children.
